[From FHQ Plus] The Quirks of Scheduling a South Carolina Presidential Primary

Georgia’s Secretary of State Brad Raffensperger recently made the curious decision to schedule the presidential primary in the Peach state for March 12, a week after Super Tuesday. And the move not only ended the hopes of Georgia Democrats holding a primary in the pre-window on the 2024 presidential primary calendar, but it also highlighted why South Carolina got the nod from the Democratic National Committee (DNC) to take over the lead off slot

The Raffensperger obstacle in Georgia, whether viewed through the lens of partisanship or not, is something with which decision makers in the Palmetto state do not have to contend. After all, like Georgia, the state of South Carolina foots the bill for the election. However, unlike Georgia, the it is the state parties in South Carolina that set the date of the contest. It is a unique power that grants the state’s primaries more scheduling mobility than the vast majority of the states and allows South Carolina to remain first-in-the-South (if not first-in-the-nation).

But that freedom in South Carolina is not without some fetters. 

Caitlin Byrd and Alexander Thompson had a nice “yes, South Carolina Democrats are actually having the first primary in 2024” story over the weekend. And complications with rogue New Hampshire (and the very likely resulting penalties from the DNC) aside, they are. South Carolina Democrats will have a February 3 primary next year. 

But as the piece notes, it is not all smooth sailing in the Palmetto state. 

But not everyone is convinced that a 2024 presidential primary would be a major financial or organizing boost. Former party chair Dick Harpootlian questioned the value of holding a potentially costly event for a predictable outcome.  

“The question is, do we have one if it’s the president versus nobody, because it costs a tremendous amount of money to do that,” he said.

Two Democrats so far have announced challenging Biden for the 2024 presidential nomination: Marianne Williamson and Robert Kennedy Jr., both widely viewed as long shots. 

Pressed if he would want a primary with the current field, Harpootlian replied, “I wouldn’t have it.”

Again, South Carolina Democrats are going to have that February 3 primary. But Harpootlian hints at some of the historical quirks in South Carolina, quirks that have taken new shape under state and national party changes. Yes, the parties have the freedom to set the date of the contest for anywhere on the calendar they wish, so long as it follows party rules. And in years past when incumbent presidents have run for reelection, those same state parties have had the freedom to cancel the contest and select delegates through a caucus/convention process. It is not some sinister plot to foil the plans of also-ran candidates. Instead, it is a nod to reality. If the president is going to be renominated, then why, in recent years since the state began funding the primaries, spend taxpayer money (or party money before that) to fund a beauty contest election? The answer is that those state parties have not. There was no big, first-in-the-South primary when Bill Clinton ran for reelection in 1996, or for George W. Bush in 2004, or Barack Obama in 2012 or Donald Trump in 2020. Caucuses and/or conventions were held instead. 

But South Carolina Democrats do not have that freedom for 2024. And no one seems to be lamenting that loss. Everyone is too busy celebrating the elevation of the primary to the first spot on the calendar instead. Well, perhaps not Dick Harpootlian. But he is not wrong, per se, nor is South Carolina alone. The primary is alone at the top, of course, but even other states or state parties that might otherwise go small in 2024 with a Democratic president running again have to go through the motions of a primary because of the Rule 2 encouragements layered into DNC rules for the 2020 cycle, the encouragements to hold the most open and accessible nominating contests as is feasible.

To be sure, folks at the DNC would push back against the notion that any state or state party is “going through the motions.” The argument from the national party would most certainly be that the party is creating the most open, inclusive and accessible process for Democratic primary voters. However, the trade-off, if one wants to call it that, is that the party loses out on the incumbent-cycle streamlining of the process. 

And that streamlining, scaling down from a primary to a caucus, is something that some, if not all of the folks, at the DNC would say is no real loss. While that may be in the eye of the beholder, it is also true that there are and have been limited opportunities to streamline anyway. State parties with party-run nominating events may downgrade — hold caucuses over a party-run primary or a convention over caucuses. And some state parties do opt out of state-run primaries in incumbent cycles. Arizona and South Carolina did on the Republican side in 2020. Democrats in Florida and Michigan did in 2012 to avoid non-compliant primaries that were scheduled too early. And Washington Democrats in the legislature canceled the primary there that cycle, a primary the party never used until 2020 (after the legislature brought it back). And there ends up being a handful of states each cycle that automatically cancel a primary if only one candidate is on the ballot. 

So, there are a few instances each cycle where contests are canceled, but South Carolina is unique among state-funded primary states in that Democrats and Republicans can choose, and have chosen, separate dates throughout the post-reform era. And since the state got into the primary funding business for 2008, just two of the four cycles have seen primary cancelations. But 2024 will be the first one where an incumbent is running and a primary is not canceled. It will be the first time the state of South Carolina has had to pay for a largely uncompetitive presidential primary involving an incumbent president.

Again, this is not the custom elsewhere. In all other primary states, there is one primary. A state party with an incumbent president may opt out, but on the whole primaries are held and delegates are allocated, typically based on lopsided results that hand the president the overwhelming majority if not all of the delegates. But the cost constraint in South Carolina represents a unique obstacle with the state parties holding primaries on separate dates. That is two separate elections to fund. 

And that brings this back to 2024. There will be two primaries. But this will be the first time the state has funded primaries when the incumbent president’s party is not opting out. No one is complaining. The legislature is not threatening the funding. It is spent in service of keeping South Carolina first-in-the-South. But as Byrd and Thompson noted in their article, Palmetto state Republicans used the costs as a justification for opting out in 2020. Democrats in the state are not doing that for 2024. 

The question is whether that action will be the only first in South Carolina for 2024. Separate Democratic and Republican primaries have been the norm. But they do not have to be on different dates. South Carolina Republicans could join Democrats on February 3, save the state the second expenditure and provide a little more room for Iowa and New Hampshire to maneuver in January. 

But that may be a bridge too far in a state with a number of quirks.

Invisible Primary: Visible -- How the Republican Candidates Line Up in South Carolina

Thoughts on the invisible primary and links to the goings on of the moment as 2024 approaches...

The 2024 primary calendar is not set yet. But if it goes according to plan on the Republican side, then Iowa Republicans will hold caucuses followed by the presidential primary in New Hampshire. South Carolina would come next, and it is the delegate prize of the early calendar. The Palmetto state not only offers the most delegates of any of the first four states, but also allocates them in a winner-take-most manner that promises the statewide victor a decent chance of sweeping the delegates with just a bit more than a 40 percent plurality. 

And that is important because a couple of recent polls of South Carolina Republicans show former President Donald Trump pulling in just north of 40 percent support. Now sure, the primary date is not even established in South Carolina, so it is definitely still early. Read into those numbers what one wants at this point, approximately nine months out from the Palmetto state primary. But Trump holds the pole position at the moment and how the candidates line up behind him matters. 

As in the majority of the current national polls of the Republican race, Ron DeSantis now is a clear second option to the 45th president in South Carolina. Behind the Florida governor are a pair of South Carolinians who are vying for the nomination as well. Depending on the poll, former South Carolina Governor Nikki Haley and Senator Tim Scott together account for anywhere from a quarter to a third of the support there. And where that support goes should either or both falter in Iowa or New Hampshire (if not the invisible primary) is consequential. As the National Public Affairs survey demonstrates, Haley and Scott are one and the same for all intents and purposes. Should Haley withdraw, then Scott would be the odds on favorite to take her support. The same is true if it was Scott dropping out. Haley would gain. 

But if both are forced out of the race, then DeSantis is the more likely beneficiary. Some of that homegrown support for Haley and/or Scott may filter out to other candidates or even stay with the favorite son/daughter if one or both remain(s) on the ballot. But if the bulk of that Haley/Scott support shifted to DeSantis, then it could be enough to vault the Florida governor over Trump statewide. 

At this juncture, it is obviously premature to speculate to that degree. But the jockeying in South Carolina matters because it is likely to give the winner of the primary a fairly significant net delegate advantage heading into the Nevada contest and beyond. That is no small thing.

The real take home from all of this is that Haley and Scott have some hard work ahead of them in potentially creating some daylight between each other back home. An early win before South Carolina, either outright or relative to expectations, may do that. But getting to that point is the real trick. That is where the hard work is.

The key state? New Hampshire. 

One has to read all the way into the seventh paragraph before it is mentioned that Biden may not even be on the ballot in the Granite state if New Hampshire Democrats choose to go rogue, opting into a primary that is likely to be set by the secretary of state for some time in January 2024. 

What this poll really indicates is that a relatively unpopular president is even more unpopular in a state where being first-in-the-nation in the presidential primary process is matter of state identity if not right (in the eyes of some New Hampshirites). Moving South Carolina up was no boon to Biden in New Hampshire. Where all of them might matter more is the general election rather than the primary phase.

In the endorsement primary, Trump continues to amass Florida congressional delegation support, picking up three more endorsements from Reps. Bilirakis, Buchanan and Waltz. The former president's campaign is not just doing this in Florida. He also claims the two biggest endorsements in South Carolina from Senator Lindsay Graham and Governor Henry McMaster. It is becoming clearer that the Trump campaign values these opponent-homestate endorsements as effective counters to candidates and would-be candidates running against him for the Republican nomination.

Invisible Primary: Visible -- South Carolina's Position in the Republican Nomination Process

Thoughts on the invisible primary and links to the goings on of the moment as 2024 approaches...

McClatchy's Alex Roarty has a good bit of invisible primary fare from the Palmetto state. Team DeSantis is beginning its build out in South Carolina, a state that figures to be interesting in the 2024 Republican presidential nomination process. Yes, the first-in-the-South primary will be one of the earliest Republican contests. And yes, there are two South Carolinians -- former Governor Nikki Haley and Senator Tim Scott -- and a former president who won the South Carolina primary in 2016 (and who has the backing of the current governor and the state's other US senator) who are vying for (or likely to contest) the nomination in 2024. 

But that does not mean that South Carolina is suddenly Iowa 1992 with Senator Tom Harkin (D-IA) running. No, efforts are underway within the broader DeSantis 2024 effort to hire staff in the state, and a couple of state legislators from the conservative-rich Upstate already look to be on board. State Rep. Josh Kimball (R) is aligned with Never Back Down, the super PAC that has been in the news because of all of its recent activity. And state Sen. Danny Verdin (R) has also spoken favorably of the idea of DeSantis running. These are important moves for any candidate who is building an operation in a state where the big names are either already running or lined up behind another candidate. And if they are not big moves then they are among the only moves a candidate can make in building a network in one of the earliest states on the primary calendar. 

Because, here is the thing about South Carolina: it is unique among the early states. While Iowa, New Hampshire and Nevada all allocate delegates in a manner proportionate to the results of their contests, South Carolina Republicans do not. The party utilizes and has for years utilized a winner-take-most scheme where the winner statewide and the winners in each of the state's nine congressional districts can take all of the delegates at stake in those jurisdictions. And that is all fine under RNC rules. All four are exempt from the proportionality requirements placed on other states with contests before March 15. 

Any DeSantis ramp up in South Carolina is a nod to both that reality and the potential for a long delegate fight ahead in 2024. A win statewide would likely mean a fairly significant early net delegate advantage coming out of the state and heading into Nevada and beyond to Super Tuesday. That is what favorite sons and daughters, like Scott and Haley, and Trump are banking on. That is what DeSantis is attempting to prevent. The rules matter. That is why, despite South Carolina politicians and a former president/primary winner running, South Carolina will continue to garner attention -- and lots of it -- during the invisible primary in 2023.

Governor Doug Burgum (R-ND) for president? Senator Thom Tillis (R-NC) to Iowa? Count those two among the invisible primary maneuverings no one expected to start the week. Yet, there was news of both Republicans' activities on Monday. Handicappers may not give either much of a chance at the 2024 Republican presidential nomination -- and to be fair, the Tillis comms team was quick to offer a Sherman-ish statement denying a prospective bid -- but these moves signal that, as Jonathan Bernstein correctly summed it up, "Republican party actors, including politicians, are not acting as if Trump/DeSantis have the nomination wrapped up between them." 

Too true. Neither Burgum nor Tillis may actually formally seek the Republican nomination, but that both are doing things that prospective presidential candidates do is a sign amid all the jockeying for support of donors, of endorsers and of voters. It is a sign that the unprecedented nature of Trump's third run (in the midst of investigations that may bring indictments, if not convictions) brings with it uncertainty. It is a sign that there may be some doubts about the long term viability of a DeSantis run (despite strong organizational signs in the midst of a "bad" week). One or both of Burgum or Tillis may run for 2024, but neither may actually end up running in 2024. Uncertainty about even well-established and well-positioned candidates breeds activity from everyone else with an eye toward the White House.

In the travel primary, Marianne Williamson drops in on the voters of South Carolina on Tuesday (March 28). Former Vice President Mike Pence heads to Iowa again on Wednesday (March 29), and Vivek Ramaswamy was just there this past weekend. Former Arkansas Governor Asa Hutchinson struck a different tone in California last week than did Ron DeSantis when the Florida governor trekked through the Golden state earlier this month. Former New Jersey Governor Chris Christie may have drawn all the headlines in New Hampshire on Monday (March 27), but former UN Ambassador Nikki Haley is also in the Granite state for town halls on Monday and Tuesday.

South Carolina's Rise to the Pre-Window

If you have not already read it, then FHQ highly recommends the recent Washington Post opinion piece from College of Charleston political scientists Gibbs Knotts and Jordan Ragusa. How the South Carolina primary gained primacy -- From first in the South to first in the Nation is a really good accounting of how, over time, the presidential primary in the Palmetto state got to where it did in the calendar proposal adopted by the DNC Rules and Bylaws Committee earlier this month. 

There were a couple of passages in the piece that made me think of a pair of stories.

1. In the section about the efforts of South Carolina Democrats to move the party-run presidential primary up in the 1992 process, Knotts and Ragusa write:
"By the 1990s, however, the success of South Carolina’s Republican presidential primary was undeniable and, in 1992, the state’s Democrats attempted to position themselves alongside Republicans as the First in the South state. Despite support for the early primary, Georgia leaped past South Carolina to host the first primary in the South that year as its governor, Zell Miller, worked with Georgia’s state legislature to secure the coveted position."
The jockeying between South Carolina in Georgia during the 1992 cycle is partly a story of a change in Democratic rules for the cycle. Following 1988, the DNC made the decision to widen the so-called window -- the period that states can hold presidential primaries and caucuses without penalty or a waiver -- by a week. In previous cycles the earliest states could conduct the first stage of their delegate selection events was the second Tuesday in March. But for 1992, that earliest point got bumped up to the first Tuesday in March

Several states took advantage of the change and moved to the new earliest position for 1992 during 1991. But none of them were from the South other than South Carolina. And that left the South Carolina Democratic primary as the first primary in the South scheduled on the Saturday before the remnants of the 1988 Southern Super Tuesday (on the second Tuesday in March 1992).

But things changed.

In early October 1991, Governor Bill Clinton (D-AR) entered the Democratic nomination race. And the story goes that Clinton discussed with his fellow southern governor, Zell Miller (D-GA), the idea of moving the presidential primary in the Peach state up to that earliest point to potentially give Clinton a lifeline on the early part of the calendar. 

Miller came to Clinton's aid, but there are two things to note here. First, Bill Clinton entered the race in October 1991, barely five months before the Iowa caucuses kicked off the voting phase of the 1992 cycle. In current presidential nomination politics that is white knight time, not a juncture in the cycle when serious contenders, much less future nominees, decide to throw their hats in the ring. Times have changed. 

Second, at that point in time -- fall 1991 -- the Georgia General Assembly was already adjourned for the year. Miller eventually leaned on the legislature, but did so when the body reconvened for the second half of the 1991-92 legislative session. HB 196 -- changing the date of the primary -- did not clear the legislative hurdle to be signed into law until mid-January 1992. And that was less than two months before the primary election. But that was not the end of the story. Section V preclearance under the Voting Rights Act was still a thing at this time and Georgia was a covered jurisdiction. The presidential primary date change still had to win preclearance from the Justice Department (which it ultimately did). 

The Georgia move is unusual in a great many respects. Primary date changes do not usually happen in the year of a presidential election. And if they do, those changes are typically intended for the next cycle. Also, this change came together rather quickly. That was also unique. More often than not, coordination on this sort of move -- one that goes through the legislative process -- takes some time (and in the case of Georgia at the time, was an effort eased by a Democratic legislature).

But that is how Georgia came to jump South Carolina -- really late -- and claimed the first-in-the-South mantle during the 1992 cycle. 


2. Knotts and Ragusa also pinpoint the 2004 cycle as a turning point for the South Carolina Democratic primary rising to the early part of the Democratic calendar. They write:
"Later that decade, the DNC prevented South Carolina Democratic leaders from holding an early primary alongside the state’s GOP contest because of national rules prohibiting primaries from occurring before the first Tuesday in March. Only two states had waivers: Iowa and New Hampshire. 
"Eventually, the DNC conceded, and South Carolina Democrats held the inaugural First in the South primary in 2004. Since then, the state has played a critical role in the race for the White House, often serving as a decisive vote after mixed, and often controversial, results in Iowa and New Hampshire."
Here, FHQ would gently push back to add some context. The 2004 cycle was important, but it did not represent a cycle in which the DNC relented and let South Carolina go early. Well, the DNC did not let South Carolina alone go earlier. As in the 1992 cycle, the DNC decided to widen the window for 2004. This time the party allowed states -- those with no waiver -- to hold contests as early as the first Tuesday in February, a month earlier than had been the case from 1992-2000. It was both a response to the Republican calendars that had come to include February contests over the previous few cycles, but also to compress the calendar and settle on a nominee as early as possible and better prepare for a run against an incumbent Republican president.

Again, South Carolina Democrats took advantage of the earlier window and moved their presidential primary to that first Tuesday in February position alongside six other states. Missouri and Oklahoma, two peripherally southern states, held primaries that same day, but, technically, South Carolina was the first-in-the-South.

It was not until after 2004 and the 2006 Price commission that the DNC moved on recommendations to expand the pre-window lineup for the 2008 cycle. Those changes brought geographic and racial diversity in to the early part of the calendar before the window opened that cycle (once again on the first Tuesday in February). They also ushered South Carolina not only into the pre-window period on the calendar, but as the lone southern representative there. 

That was what gave South Carolina Democrats the early (first-in-the-South) and a distinct (with a pre-window waiver) position that it still holds. Only, the proposed slot for the Democratic presidential primary in the Palmetto state is slightly earlier in 2024.

Why South Carolina Got the Nod to Lead the 2024 Democratic Calendar

It has been a while since the national parties have either allowed states other than Iowa and New Hampshire to go first on the presidential primary calendar or have failed to expressly protect the traditional first pair in their rules. 

In fact, the entire post-reform era since the 1972 cycle has operated that way in both parties' processes. Now, to be clear, states have challenged Iowa and New Hampshire throughout that period, but the two have always been able to maneuver around those threats on their own -- banded together in first-in-the-nation solidarity or individually -- or in recent years, have kept their spots, protected by national party rules. 


The decision by the DNC Rules and Bylaws Committee (DNCRBC) late last week to adopt the proposal put forth by the president stripped Iowa of its position and effectively/indirectly did the same to New Hampshire. Instead of the usual two states at the front of the queue, South Carolina got the green light to move up from the fourth and final spot in the pre-window -- the one that the Palmetto state has held in the Democratic nomination process since the 2008 cycle -- all the way up to the top slot. 

President Biden's late input on the DNCRBC process to award waivers to four or five states to lead the 2024 calendar upset the emerging consensus that Nevada and New Hampshire were the states vying for the honor of going first. The proposition also set off a flurry of chatter that South Carolina received the prized spot because the state had rescued his primary campaign in 2020 and/or that it was meant as a favor to Rep. Jim Clyburn (D-SC, 6th), whose endorsement appeared instrumental in the days leading up to the late February primary in the Palmetto state. That all may be, but it is not anything that is foreign to this process. Incumbent presidents tend to support the rules -- calendar and otherwise -- that got them to the nomination, and Biden has done just that, at least in part. 

Is that intended to insulate himself against a primary challenge? Again, that would not be a foreign concept. Jimmy Carter's team nudged state legislators in several states -- notably in the South -- to shift their primaries to earlier dates during the 1980 cycle to counter expected (Ted) Kennedy wins in the northeast. And just last cycle, the Trump campaign leaned on a number of states to shift from primaries to caucuses (or to cancel contests altogether) in order to produce electorates likely to minimize or eliminate any opposition success.

The only catch in the 2024 discussion is that there is no looming (and legitimate) challenge to Biden on the horizon. Of course, there is plenty of time for that to change and besides, the president may -- although it does not appear that way at this time -- pass on a reelection bid.

Nonetheless, the South Carolina ascension has "reignited tensions" in the Democratic Party that has some crying foul. And at least some of that is based on the perceptions that some of the above historically consistent actions by incumbent presidents are now wrong in some way. Others have pointed to the Palmetto primary as a poor lead off contest because the state is a virtual lock for Republicans in the electoral college. 

That criticism is all entirely fair. 

But is also overlooks some of the very real and practical reasons that South Carolina ended up first in the proposal. 

To examine this further, let's look at the DNCRBC's own criteria for states to attain an early window waiver. Early on in the process before applications for waivers were submitted, the DNCRBC highlighted diversity, competitiveness and feasibility as markers the panel would use in considering states for potential waivers.

Diversity
South Carolina hits the mark for the most part on diversity. That African Americans comprise a majority of the primary electorate there was clearly something the committee and the president prized as a component of raising minority voices in the process. That is basically why the state was added to the early state lineup for 2008. The state is a nice mix of urban, suburban and rural as well, and is also relatively economically diverse. However, South Carolina is a right-to-work state, which is a knock on the state in a party that values unions/labor interests. Finally, South Carolina is a southern state and has been the lone representative from the South among the first four states since 2008. 

Let's pause there because South Carolina is not the only southern state from which the DNCRBC could have chosen. And, in fact, the committee also designated neighboring Georgia to also appear in the pre-window. But this factors in elsewhere.

Competitiveness
Nope, South Carolina is not a competitive general election state for Democrats. Organizing there for the primaries and not simultaneously preparing for the general election seems like something of a sunk cost (or at the very least an inefficient use of finite resources). That is why the committee had targeted competitive states. So South Carolina does not fit the bill there. 

Feasibility
If one looks at the checklist above, South Carolina has a couple of checks by racial diversity and regional diversity (across the whole lineup of early states). That is neither an exhaustive nor overwhelming list of positives in the favor of South Carolina Democrats. But recall that the primary reason driving the DNCRBC decision in July to punt on the final early calendar lineup until after the midterms was that state were still working on “answering several final but critical questions regarding election administration and feasibility in their states.”

So, to return to the question from above, why South Carolina and not some other southern state? Feasibility.

There are roadblocks in the way of the DNRBC adding another southern state other than South Carolina. Much of it has to do with partisan composition of state government. Republicans dominate most states in the region and have an interest in following RNC rules that forbid states other than Iowa, New Hampshire, South Carolina and Nevada from holding contests before March 1. 

Here's how that looks (based on what entity makes the decision on the date and administration of a primary election):
Alabama: unified Republican control of state government
Arkansas: unified Republican control of state government
Florida: unified Republican control of state government
Georgia*: Republican secretary of state
Kentucky: Republican legislature
Louisiana: Republican legislature
Mississippi: unified Republican control of state government
North Carolina: Republican legislature
Oklahoma: unified Republican control of state government

Very simply, South Carolina is maximally maneuverable in the Democratic process compared to all of the other southern states, much less those that applied. 

That maneuverability also likely played a role in South Carolina getting the call over another diverse state that had high hopes of vaulting to the top slot, Nevada. Again, South Carolina Democrats, under state law, can move to a position on the calendar of their choosing with no input from Republicans who control the state government there. 

The midterms changed the calculus in Nevada. The formerly unified Democratic government in the Silver state became divided when Republican Joe Lombardo won the gubernatorial race in November. That meant that Nevada was most likely stuck with the February 6, 2024 date for its newly established presidential primary. Democrats could not move it earlier because Lombardo would not be inclined to take on possible RNC penalties. Ironically, the switch to a primary that was seen as a feather in the cap of Nevada Democrats in this waiver process came back to haunt them. Under a caucus system like the state had in 2020, Nevada Democrats would have been much better able to move around to suit any date the DNCRBC may have placed them in (...although the committee, the president and the party as a whole have largely rejected caucuses in the Democratic nomination process).

In the end, political favoritism may have played some role in the South Carolina Democratic primary rising to the top, as did diversity, but feasibility was also a major, major component in the reasoning behind the move.

If It Was So Easy to Change Then It Would Have Changed By Now

FHQ read with some interest the latest editorial from Michelle Cottle at The New York Times before the weekend hit. It was one of a genre the vintage of which one sees in the seemingly lazy days between presidential nomination cycles. One can call those of that ilk the "it's time for a change (to the presidential nomination process)." Sure, they are around every cycle, but they tend to most often arise in the midst of (or perhaps just before) a new round of presidential primaries and caucuses. 

In other words, they often come too late. So in Cottle's defense, at least her call for reform is coming at a time in which it may actually matter: before the national parties set their rules for the upcoming cycle. Granted, FHQ's defense of the piece only goes about that far. Much of it leans on a sort of Green Lantern theory of presidential nomination reform. If only the interested players tried a bit harder, then all the ills of the process would be gone. But that theory and this piece ignore the realities of reform. 

If it was as easy to change the process as it is made out there, then certainly things would have changed by now, nearly half a century into the post-reform era. But those rules do not change with ease. They are and the presidential nomination process is a tremendous collective action problem for the parties. And while consensus may (or may not) exist to make changes, agreeing to what those tweaks will be is a much more difficult enterprise when considering the mix of interests involved: the national parties, the state parties, the state governments, the candidates and their proxies on rules-making bodies. Getting enough of those groups on the same page is tough enough in the abstract, but the climb is steeper still when the politics of any given moment intersect with the process. 

Now may be one of those times when the moment is right for change. Iowa Democrats bungled their caucuses in 2020. Neither primary or caucus electorate in Iowa nor New Hampshire matches well with the current constituency of the broader Democratic Party coalition of the moment. And there seems to be a willing candidate to fill their void on the primary calendar. Maybe the stars will align. However, missteps may scuttle any potential for change. Nevada Democrats may be at some risk of overplaying their hand. The conditions are right, but the provocative nature of their January primary bill may complicate its efforts, riling up not only New Hampshire as Cottle points out, but also the national party.

And that is what often gets lost in these primary reform prescriptions that pop up every four years. They can raise the ills of any given process, but often fail in considering the process for bringing about such a change. 

Take Cottle's consideration of caucuses in 2020. Caucuses are not new, nor are the problems associated with them. She notes that "caucuses are a convoluted, vaguely anti-democratic way to pick a nominee," and that "the Democratic National Committee urged the state parties to shift to primaries." The DNC did and as Cottle mentioned, most states responded. This was quietly a big deal for the DNC. It was a rules change that worked and worked really well. It was not a new directive from the national party to hold primaries because some states -- Kansas, for example -- are controlled by the Republican Party on the state level and were not open to establishing a primary. In fact, after years of caucusing in the face of unfunded (and ultimately cancelled) primaries, Republicans in the Sunflower states eliminated the primary option once and for all in 2015.

But even most states in that bind adapted. Most adopted party-run primary systems that had early and mail-in options for those seeking to participate in the process. Sure, the national party would prefer state government-run primaries, but lacking that alternative in some states produced something of a laboratory for innovative party-run primary plans. Best practices derived from those states may serve as a call to action in states like Iowa where there, for now, continue to be caucuses. But Iowa is also a state where the Republican Party is calling the shots in state government. There is the delicate balance to tread with New Hampshire, but there are some success stories from the 2020 cycle that should be celebrated rather than barely mentioned. Often it is those incremental changes that prove the most consequential. 
 
In the end, however, other changes -- like those to the beginning of calendar -- are tougher. Not impossible, but difficult. And it will take more than "the national party seiz[ing] the opportunity to shake even harder, reforming a system that’s increasingly out of touch with voters." It will take the national party working with interests on the ground in the states to make it happen. And as the last fifty years have shown, that is easier said than done.

The Week the Calendar Wars Heated Up

The week began with Nevada making the opening move in the 2024 presidential primary calendar wars, a move made on the foundation set by the Iowa caucuses debacle in 2020. David Siders and Elena Schneider at Politico had a well-reported piece that covered voices from all over the early calendar state terrain. 

Let's read a bit between the lines with an annotated look at some of the more interesting points in the article.

On Iowa:
As has been pointed out in other reporting, there seems to be dissension in the ranks among Iowa Democrats about the future of the caucuses. That comes out again in this Politico piece. Newly elected Iowa Democratic Party chair, Ross Wilburn toed the party line:
"In Iowa, the state’s Democratic Party chair, state Rep. Ross Wilburn, said he is 'prepared to do whatever it takes to keep Iowa first in the nation.'"
But there are some doubts:
"Nevada’s move this week intensified conversations among top Iowa and New Hampshire operatives and activists eager to prepare their defense, and privately, several Iowa Democrats acknowledged that their status was in serious jeopardy."
This will continue to be something worth tracking in Iowa. There is outright dissension on keeping the caucuses intact within the state party, but how widespread it is remains to be seen. In any event, signs of resignation or that 2024 might be different for Iowa Democrats are present in a form that really has not shown itself publicly in the post-reform era. This is probably the story with Iowa moving forward because the DNC Rules and Bylaws Committee will not be blind to any other chinks in the armor in the Hawkeye state.


On Nevada's play for first:
"Nevada’s Democratic Assembly Speaker, Jason Frierson, suggested the bill was a starting point for a 'national conversation about what makes sense.'

"'It would not be ideal to just have a back-and-forth and just have a leapfrog exercise,' he said, 'so the hope is that we can coordinate with the national party as well as our states, and work something out.' Frierson said he 'certainly [is] not trying to start some dispute between states,' adding that 'this is the beginning of the conversation.'"
Frierson's comments here are enlightening. They reveal that Democrats in the Silver state are going to take an early and aggressive approach to the 2024 calendar. Viewed through that lens, this -- the introduction of the January presidential primary bill -- is a provocative action rather than one intended to lay the groundwork for a case to be first pitched to the national party. Instead, the legislation, a bill that is basically a replica of earlier Nevada Republican proposals, is an opening salvo meant to force the issue not only with other carve-out states, but with the national party. Again, as FHQ has pointed out, it is not clear how receptive the national party will be to such a maneuver.


On the DNC taking up the calendar issue:
"'It’s unclear when the Democratic National Committee will formally take up the calendar issue.' David Bergstein, a DNC spokesperson, said in an email that 'the DNC's Rules and Bylaws Committee will continue to evaluate all areas of our nominating process and make recommendations for any changes.'"
The calendar will come up. It always comes up. Always. And the calendar will definitely be a component of the DNC Rules and Bylaws Committee report on the 2020 Democratic presidential nomination process due out in March. Yes, this is expectations setting on the part of the DNC spokesperson. Change may or may not come to the beginning of the primary calendar, but the issue will be raised, and this is a fairly clear attempt at tamping down on the expectations of change to a part of the nomination process that is both thorny and difficult to alter. Otherwise, Iowa and New Hampshire would have been uprooted by now.


On Iowa and New Hampshire conducting unsanctioned contests in 2024:
"Iowa and New Hampshire could also choose to buck the party. States have done that before, as Florida and Michigan did with early primaries in 2008 in defiance of party rules. Asked whether Iowa could hold an unsanctioned caucus — daring candidates not to campaign there — Dave Nagle, the former congressmember and Iowa state Democratic Party chair, said, 'Sure.'"
While it is true that Iowa and/or New Hampshire (or any other state for that matter) could hold an unsanctioned primary or caucus, this fails to mention the penalties involved. Yes, Florida and Michigan ignored those penalties in the 2008 cycle and the first two states could do that in 2024 if the DNC does not give its blessing. But this scenario omits the Rule 21.C.1.b penalty levied against candidates who opt to campaign in rogue states. That would strip a violating candidate of any delegates won in a state in violation of the timing rules. We just do not know how candidates and their campaigns would behave in that eventuality. There is every reason to believe that candidates would flaunt the rules and campaign in hypothetically rogue Iowa and New Hampshire. They would be opportunities to gain attention. But there are also reasons to believe that candidates would avoid the states to focus on those that are sanctioned by the national party, are more diverse and have more delegates at stake.


On New Hampshire just doing what New Hampshire always does by leaping every challenger:
"For every state that has tried to move ahead of Iowa or New Hampshire, he [Dave Nagle] said, 'it generally does not have a happy ending. ... The one thing they’re ignoring, and it shows their inexperience out there [in Nevada], the one thing is Bill Gardner in New Hampshire. Bill will go to July of 2021 if he has to to keep the first primary.'"
Nagle is completely right here. There have been few happy endings in challenging the early states over the years. But how do things end if the DNC opts to change its rules at the beginning of the calendar and it is Iowa and New Hampshire that are staring down the prospect of the penalties being turned on them instead of others? That is the thing that is not being discussed enough in the context of New Hampshire in particular


On the DNC banning caucuses altogether:
"'The big question for Iowa Democrats, being talked about in sotto voce, is, does the DNC ban caucuses altogether?' said John Deeth, a Johnson County, Iowa, Democratic activist who supports eliminating the caucuses and replacing them with a primary. 'If they do that, Republicans, however, hold on to a trifecta of the legislature and the governor’s office [in Iowa], and they are not interested in passing a primary bill for Democrats … and that leaves us with only bad options.'"
FHQ does not get the sense that there is much of an appetite to outright ban caucuses, especially after the rules changes for 2020 encouraging primaries was such a success. In 2016, 14 states (not counting territories) conducted caucuses. Four years later after the rules changes that number was down to just three. And the pandemic pushed the Wyoming caucuses to a mail-in party-run primary model. So it was really just Iowa and Nevada that conducted caucuses in 2020. That is a successful rules change. Iowa may not have Democratic caucuses in 2024 and may get no help from state Republicans in pulling off a primary, but there are other options as demonstrated by a number of party-run primaries in 2020.

All of this remains in flux, of course, but even in mid-February of 2021 the rules for 2024 are beginning to take shape and states are already attempting to position themselves on the calendar.

Are the Parties Taking Different Paths on the 2024 Primary Calendar?

Since the inauguration the other week FHQ has devoted considerable (virtual) ink to the 2024 presidential primary that is coming into shape, even two years before the first serious/viable candidates are likely to throw their respective hats in the ring. 

Look, it is early. But already there are some important stories about the 2024 nomination processes and particular focus has been placed on the order of the earliest states on the primary calendar. Iowa had problems with its caucuses in 2020. Nevada is considering a switch to a primary, and further may opt to challenge Iowa and New Hampshire in so doing. And New Hampshire is New Hampshire: free to allow an empowered secretary of state to simply wait things out (and hope the national parties do not turn their penalties on the Granite state to enforce a new order).

All of this -- even among a small group of states -- highlights the overlapping interests and incentives involved in both maintaining and reforming (or often merely tweaking) the rules that govern how both national parties select and allocate the delegates that ultimately nominate their presidential candidates. 

The national parties on some level enjoy the stability/certainty of an early calendar order that persists across cycles. No, it may not be perfect for one or both parties, but the devil one knows is often preferable to the unknown one that may bring with it unintended consequences that leave a system worse off than the status quo ante. And that is often true even in the face of (legitimate) pressure to make changes from groups within the broader party coalition. 

The states and state parties offer at least two other sets of interests and incentives and they two do not always work in concert with one another (and sometimes that goes beyond just simple partisan differences between the governing party in a state legislature -- if there is a unified one -- and an opposition state party). 

Take the delicate dance now starting in Nevada. Democrats control not only the state legislature, but the state government. Between the legislative and executive branches, there is unified Democratic control. Both seeing an opening in the wake of Iowa's 2020 issues and responding to pressure within the Democratic party coalition, the state government seems poised to move away from caucuses as the means of allocating national convention delegates to a state-run presidential primary. And Republicans in the state -- both in the legislature and within the formal state party apparatus -- are not opposed to that change.  And that is a reflection of the different incentives on the Republican side within the party coalition and ahead of a likely open and competitive presidential nomination race in 2024. 

Those realities make it less likely that Nevada Republicans will have any desire to rock the boat. And that shows, particularly when it comes to any effort to move any hypothetical Nevada presidential primary to the first position on the primary calendar. Silver state Republicans very simply do not want to jeopardize their current position in the order. 

And that is a concern of sorts on the Democratic side as well. The forthcoming primary bill's sponsor, Nevada Assembly Speaker Jason Frierson (D), told the Las Vegas Review-Journal:
“We will have to work through (the bill’s) language and work with the national parties — both Democrats and Republicans — and convince them of Nevada’s importance in the West.”
DNC member from Nevada, Allison Stephens, in the same story added:
“We don’t want to compromise our position as No. 3 in the nation. We can not fall below third. If changing to a primary would jeopardize our early state status, I would be concerned. We do have to work within the parameters of the party.”
But although the interests and incentives may be similar, the actions to this point in the cycle across the two parties are noteworthy. This primary effort may go forward with bipartisan support in the Nevada legislature, but both sides on the state level are cognizant of the stakes there and on the national party level. And so far the two parties have diverged in important ways. 

On the Republican side, there has been a concerted effort among carve-out state members of the Republican National Committee to band together in order to protect the status quo. That is why Nevada Republican Party chair, Michael McDonald acknowledged a desire in the state to be first but also noted that:
"We're united with the RNC to make that happen. We have a great working relationship with the four carve-out states and a great working relationship with the RNC. We respect each other and we don't intend to move anything. We respect each other's position."
Democrats in Nevada and nationally are performing a similar dance, but the one big thing to this point in how the calendar in particular is coming together for 2024 is that the same carve-out state coalition to protect the status quo start to the primary calendar has not yet materialized among the national party membership from those states. That is not to suggest that that will not happen. But it has not to this point, in stark contrast to how carve-out state Republicans are approaching the cycle. 

This may in retrospect months from now be much ado about nothing. But it could also be that once again there is a different approach to this across parties. And importantly that says something about the stability of the system long term. Changes tend to last when both parties agree to them, whether formally or informally. And there is a divergence between the two parties at this early juncture.

The Electoral College Map (10/28/20)

Update for October 28.


Wednesday was another one of those days full of poll releases from across the board. In total, there were data from 22 new surveys in 12 different states added to the FHQ polling dataset for 2020. And while all six categories were represented, it was the middle column in the Electoral College Spectrum below -- the one with the most competitive states -- that was most heavily polled in this batch. Nevada was the only blue state toss up with no new survey data on the day and Iowa and Ohio were the only ones on the Trump side of the partisan line without any new polls. That means that the most frequently surveyed states got another infusion of data, but the end result was only minor movement. Six of the states shifted in Trump's direction and another five saw their margins move toward Biden. North Carolina held steady from a day ago. 

But again, the bottom line is that with six days left in the presidential campaign before voting concludes, Biden maintained the lead in the electoral vote tally that he has held for the last week.

On to the polls... 


Polling Quick Hits:
Arizona
(Biden 48, Trump 44 via Gravis Marketing | Biden 49, Trump 43 via Justice Collaborative Institute | Biden 50, Trump 45 via Univision | Biden 52, Trump 45 via Patinkin Research Strategies)
[Current FHQ margin: Biden +3.04] 
Arizona added the most new polls on the day, and importantly, the six new polls, including two backlogged surveys from Patinkin Research, nudged the average margin there back above Biden +3. On the whole, however, this group of surveys was fairly consistent with the established 48-45 lead the former vice president currently holds in the Grand Canyon state. The first Gravis poll of Arizona since September had both candidates losing support. The 50-48 Biden advantage then doubled but brought the series in line with the current average in the state. Both the Univision and JCI surveys hit the target on one candidate's average share of support, but missed the mark on the other. In the JCI poll, Biden's share was on par with his average while Trump lagged behind his. The opposite was true of the Univision survey. There, the Trump share in the survey matched his average share at FHQ while it ended up having Biden out in front of his average share. Finally, the Patinkin update to an early October survey that found the Democratic nominee up 50-46 saw that margin increase even further, pushing Biden beyond 50 percent. The former vice president has hit that mark less frequently in Arizona than in, say, the blue wall states, but he has hit or exceeded the majority mark 19 times in the 98 polls conduced in Arizona in 2020. And roughly a third of those have come in October. 


Arkansas

A rare new poll of the Natural state was conducted by the University of Arkansas and had the president doubling up Biden. This wide gap in this survey is mostly consistent with the 61-35 average margin Trump currently maintains at FHQ. But that average makes Arkansas one of those states that hardly looks different from the 2016 presidential results. Biden's average share is a little more than a point ahead of Clinton finish there and Trump is actually slightly ahead of where he ended up in Arkansas four years ago.


Florida

Univision's first poll of the Sunshine state in calendar 2020 does not stray far from the established 49-45 (rounded) average at FHQ. And Florida is one of those states with a below average swing relative to 2016. Biden has only tacked on a point and a half on to Clinton's showing there, and Trump is running only about three and a half points behind his pace. In total that is still a shift in the Democrats' direction the 2016 election to 2020 polling, but it is one that falls short of the nearly seven point average swing across the country. 


Georgia

North of the Sunshine state in Georgia, Monmouth was back in the field with another survey gauging opinions on preferences in the presidential race. And there has been a fairly substantial swing in the low turnout model that FHQ has been imputing into the dataset since the university pollster found Trump ahead 50-45 last month. But that was a bit of an outlier. Trump has not been back up as high as 50 percent in any Peach state poll since the September Monmouth survey. Moreover, he had not hit the majority mark in a poll until that September survey since July.  But this month, it is Biden and not the president who is at 50 percent. For comparison, since that September Monmouth survey, the former vice president has surpassed the majority barrier seven times. [NOTE: Using the high turnout model data -- a 50-46 Biden advantage -- would have increased the average FHQ margin to Biden +0.32.]


Maine

There is far less suspense statewide in Maine or in ME CD1 and the update from Colby College confirms that. The numbers both statewide and in the southern, more urban district moved toward Biden since the last poll in September. But the margins shifted a sliver toward Trump because they both came in under the established average margins in both jurisdictions. And while the more competitive ME CD2 was largely unchanged in the time since the last Colby survey -- Trump dropped a point -- the average margin inched upward and toward Biden nearly syncing it with the average margin in North Carolina.


Michigan

It was another day with not only multiple polls of Michigan but with all them finding the former vice president hovering around 50 percent as he has for weeks here at FHQ and the president stuck in the low to mid-40s. The Siena survey was an update to a poll of the Great Lakes state earlier this month and represented no real change. A 48-40 Biden lead then morphed into a 49-41 advantage now. The margin may have closed some in the update the last Glengariff poll earlier in October, but it also had Biden's support pushing closer to 50 percent, a mark the Democratic nominee has been closing in on in the FHQ averages for a while now. The first-time ABC/WaPo survey basically fell in line with the current 50-43 (rounded) margin Biden leads the president by at FHQ. None of the trio find Trump significantly closing the gap in a state he flipped in 2016 but does not absolutely have to defend in 2020. 


North Carolina

In the Tar Heel state, a pair of new surveys continued giving fodder to the FHQ mantra for the race there: It is close but consistently tipped in Biden's favor. The Gravis poll is the firm's first in the state since June and although both candidates have increased their support from Biden's 46-43 lead at the time, the margin has remained exactly the same. Harper Polling's surveys for Civitas in North Carolina have been the model of consistency since summer. It has been a one point race in one direction or another since the firm's August poll. And it was Biden's turn to lead in October after Trump had his turn last month. Neither poll is far off of the 48-46 (rounded) FHQ average in the Old North state.


Pennsylvania

Like the Arizona and Florida polls, this was the first Univision survey of Pennsylvania as well. And even as the margin falls short of the five plus point FHQ advantage the former vice president has in the Keystone state, it is consistent with the 50-44 (rounded) lead there. And this was another poll with Biden at or above 50 percent in the commonwealth. Looking at the swing in Pennsylvania from 2016 to now, it appears to be a lot like Florida. Biden here is ahead of Clinton by a little more than a point and a half and Trump is lagging behind his 2016 performance by more than three and a half points. Together, that shift is slightly below the nearly seven point average swing across all states. 


South Carolina

If it is a South Carolina poll this week, then it must have Trump in the low 50s and Biden trailing in the mid-40s. That has been the trend so far this week anyway and both the Data for Progress and ECU polls fit that bill. And neither survey has changed that much since either was last in the field in the Palmetto state. In the two weeks since Data for Progress conducted a South Carolina poll Trump's 52-43 lead has shrunk by a couple of points. ECU's last survey was the first in the state way back at the beginning of February, and that registered voters sample then also had Trump at 52 percent. Biden saw more growth since then in the transition from registered to likely voters, but only enough to pull him in line with his average level of support as measured by FHQ. 


Texas

The update to the last Univision poll in Texas resembles the timeline in the Gravis surveys of North Carolina discussed above. A February poll of registered Lone Star state voters had Trump out to a 46-43 lead. But time and the switch to likely voters for the latest poll are more consistent with the current 48-46 (rounded) advantage the president holds in Texas. As FHQ has mentioned before, Texas continues to be the North Carolina of the Trump side of the partisan line. The two states are mirror images of each other with Trump holding the same 48-46 lead that Biden has in North Carolina. That consistency in both should be noted heading down the stretch of this race. 


Virginia

No other poll has found the race for the 13 electoral votes in the Old Dominion as close as the September Christopher Newport survey did. So, that the university pollster's latest Virginia poll has replaced that 48-43 Biden lead from then with a margin (not to mention candidate shares) to match those at FHQ is noteworthy. Virginia just is not in 2020 the swing state that it was in 2008 or 2012 (or even 2016 for that matter).


Wisconsin

Finally, the two new polls in the Badger state tell differing tales. Neither is wholly inconsistent with the recent data on the Trump side of the equation although the ABC/WaPo finding is on the low end of the president's range. But the real difference is on the Biden side. The former vice president was already above 50 percent in the last ABC/WaPo survey of Wisconsin last month, but for Biden to hit 57 percent this month is for him to hit his peak in polling of the state this year. It also nudges him a little closer to a 50 percent average share at FHQ. In fact, Michigan, Pennsylvania and Wisconsin have all been huddled up against but under that average threshold for a while with Michigan closest to crossing first. But on the weight of this new ABC/WaPo poll, Biden's average share in Wisconsin is now closer to 50 percent than in Michigan. The Marquette poll continues to find the margin in the Badger state on the low side compared to other polling. But it also may have been more consistent across the series. This latest poll is barely different from the 47-42 lead Biden held in the last Marquette poll earlier this month.

2 The numbers in the parentheses refer to the number of electoral votes a candidate would have if he or she won all the states ranked prior to that state. If, for example, Trump won all the states up to and including Pennsylvania (Biden's toss up states plus the Pennsylvania), he would have 285 electoral votes. Trump's numbers are only totaled through the states he would need in order to get to 270. In those cases, Biden's number is on the left and Trump's is on the right in bold italics.

3 Pennsylvania
 is the state where Biden crosses the 270 electoral vote threshold to win the presidential election, the tipping point state. The tipping point cell is shaded in yellow to denote that and the font color is adjusted to attempt to reflect the category in which the state is.

Things really have settled in at FHQ and time is running out for anything to significantly change between now and election day next Tuesday. That is not to say that nothing can or will happen to disrupt this race but that time and folks who have not voted are both dwindling. FHQ mentions that as preface to saying on another day that little has changed around here. The map and underlying electoral vote tally are where they have been for a week, the order of states depicted in the Electoral College Spectrum is unchanged from a day ago and the same seven states that populated the Watch List yesterday are there again today. That is just the way it is, but tomorrow may bring some new data that will alter that.

Methodological Note: In past years, FHQ has tried some different ways of dealing with states with no polls or just one poll in the early rounds of these projections. It does help that the least polled states are often the least competitive. The only shortcoming is that those states may be a little off in the order in the Spectrum. In earlier cycles, a simple average of the state's three previous cycles has been used. But in 2016, FHQ strayed from that and constructed an average swing from 2012 to 2016 that was applied to states. That method, however, did little to prevent anomalies like the Kansas poll that had Clinton ahead from biasing the averages. In 2016, the early average swing in the aggregate was  too small to make much difference anyway. For 2020, FHQ has utilized an average swing among states that were around a little polled state in the rank ordering on election day in 2016. If there is just one poll in Delaware in 2020, for example, then maybe it is reasonable to account for what the comparatively greater amount of polling tells us about the changes in Connecticut, New Jersey and New Mexico. Or perhaps the polling in Iowa, Mississippi and South Carolina so far tells us a bit about what may be happening in Alaska where no public polling has been released. That will hopefully work a bit better than the overall average that may end up a bit more muted.
